These Terms of Service ("Terms") govern your use of Domain Quest's domain discovery platform and services (the "Service") operated by Domain Quest, LLC ("we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the Service.

Description of Service

Domain Quest provides an AI-powered domain name discovery platform that includes:

• AI-generated domain name suggestions
• Real-time domain availability checking
• Domain watchlist and monitoring features
• Domain organization and export tools
• Quest-based domain discovery interface

Account Registration

To use certain features of our Service, you must:

• Create an account with accurate and complete information
• Be at least 13 years old (or 16 in the EU)
• Be legally capable of entering into binding contracts
• Not be barred from using the Service under applicable law

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Subscriptions and Billing

Subscription Plans

We offer various subscription plans with different features and credit allocations:

• Starter Plan: $5/month - 700 credits
• Pro Plan: $10/month - 3,000 credits
• Business Plan: $25/month - 15,000 credits

Billing and Payments

• Subscriptions are billed monthly in advance
• All payments are processed securely through Stripe
• Prices are in USD and subject to applicable taxes
• You authorize us to charge your payment method on a recurring basis

Credits and Usage

• Credits are used for domain generation and availability checks
• Unused credits do not roll over to the next month
• Credits cannot be transferred or refunded
• Additional features may have plan-specific limitations

Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial months or unused credits.

Acceptable Use

You agree not to use the Service to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Generate domains containing offensive, harmful, or illegal content
• Attempt to circumvent usage limits or security measures
• Use automated systems or bots without permission
• Resell or redistribute the Service without authorization
• Interfere with or disrupt the Service or servers
• Collect or harvest user data from the Service

Intellectual Property

Our Content

The Service, including its original content, features, and functionality, is owned by Domain Quest and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Your Content

You retain ownership of any domain names you discover or content you create using our Service. By using the Service, you grant us a limited license to process and display your content as necessary to provide the Service.

AI-Generated Content

Domain suggestions generated by our AI are provided as-is. We make no claims to ownership of AI-generated domain names, and you are responsible for verifying their availability and suitability for your use.

Third-Party Services

Our Service integrates with third-party services for various functions:

• WHOIS APIs for domain availability checking
• OpenAI for AI-powered domain generation
• Stripe for payment processing
• Domain registrars for purchase links

We are not responsible for the practices, content, or services of these third parties. Your use of third-party services is governed by their respective terms and policies.

Service Availability

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

Domain Information Accuracy

While we strive for accuracy, domain availability information may not always be current or complete. Always verify domain availability directly with a registrar before making purchase decisions.

No Legal Advice

Our Service does not provide legal advice regarding domain names, trademarks, or intellectual property. Consult appropriate professionals for legal guidance.

Limitation of Liability

To the maximum extent permitted by law, Domain Quest shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from your use or inability to use the Service
• Any unauthorized access to or alteration of your data
• Any third-party content or conduct on the Service

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Domain Quest, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service or violation of these Terms.

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including:

• Non-payment of fees

Upon termination, your right to use the Service will cease immediately. Provisions of these Terms that should survive termination will remain in effect.
